1) Premise / Introduction
The property is conceded in short hold tenancy, only for touristic purposes, according to section 1 (2) (C) of law n° 431/98. The tenancy is not therefore subject to the c.d. normative as required by section 2 b (A), n° 392/978.
2) Bookings
The booking is confirmed only when the required bond is received. For the booking to be complete, the client ought to accept the following terms and conditions.
3) Payment
The bond is equivalent to 30% of the total rent and should be paid directly to Immobilservice snc, by postal order or bank transfer to Cassa di Risparmio Padova e Rovigo Spa, branch of Jesolo Lido. The confirmatory bond as requested by law 1385 C.C. will be deducted from the total rent at arrival. The full payment together with possible additional charges (electricity, water rates, gas) will be finalised at the tenant’s arrival. The key to the property will be handed over as long as full payment is received and the client provides the below required documentation.
4) Arrival
The arrival must occur the prestablished day, between 4 pm and 7 pm. In case of a late arrival, the tenant should notify Immobilservice snc. If left unnotified, the property will be put at hold for 24 hours, after which the agency reserves the right to rent the property to third part. At arrival the client is required to exhibit the appropriate identification documents such as passport, ID card, driving license. To speed up the process, the client is advised to fill all the full details of each person inhabiting the property in a special form, that he/she can find out of the agency.
5) Cancellation
In case of cancellation, the tenant has to give Immobilservice Snc at least 5 weeks notice. However, if the agency is unable to reoccupy the property, the tenant is obliged to pay the whole rent. If the property is reoccupied, only a written cancellation will guarantee the restitution of the bond, from which 10 % + VAT will be deducted for handling fees. In case the tenant wishes to terminate the stay in advanced, Immobilservice won't give back either the rent nor the additional expenses paid.
6) Terms and conditions of stay
The presence even if occasional in the property of a number of people superior to the contracted amount will involve the termination of the contract, according to the law 145 b C.C. This will also entail the obligation to pay an extra fee to Immobilservice Snc as agent of the landlord. In this regard children will be considered as adults. If requested, Immobilservice snc will be able to authorise the stay of one extra person with a charge, only if permitted by the law in force. Family pets will be allowed in the property only if full authorisation is given by Immobilservice snc, in accordance with the regulations and restrictions in force. The use of own electric heaters and stoves will not be permitted. All the guests are required to respect the rules of each house/flat regarding noise control in the afternoon and late at night. The agency cannot be held responsible for lost/forgotten property; client not satisfied with the accommodation (booked by phone); sub rental and/or substitution and/or alternation between parties are at all times forbidden.
7) Swimming Pool
Opening times are normally from the beginning of June till mid September, weather permitting.
8) Beach
Extra charge for beach service ( sunbeds and sunumbrellas).
9) Equipment of property
All accommodation is full and furnished, provided with electrical or gas stove, hot and cold water, refrigerator, electricity (220 volts). If the tenants needs a gas cylinder Immobilservice will contact the provider of gas cylinder for equipment. Each bed is equipped with own mattress, one cover and one pillow. Dishes, pans, cutlery is also provided. The client is asked to take with own bed lines, kitchen lines and bathroom lines. The tenant has to inform of any damages will result in the tenant being held responsible and subsequently charged for the repair.
10) Departure
Any desire to prolong the stay must be agreed upon with the agency. On the established day, the tenant should leave the property by 10 am. Departure should take place during office hours to allow a deputy to check the state and clearness of the property. On request, Immobilservice Snc can authorise departures outside office hours; in this case we reserve the right to hold the bond until opportune checks have been made. The caution money will be send to the tenant per post mail. The postal cost will be deducted from the caution. The property should be left tidy, rubbish removed, clean furniture, floors and kitchen. Appliances should be appropriately washed and put away; fridge should be defrosted (door open; switched off motor).
11) Caution money
The tenant commits to keep the accommodation in order and to respect all the provided appliances. Damages to structure and appliances will be charged to the tenant. As a guarantee, the Agency asked for an unprofitable sum (€ 100,00-200,00) which will be fully returned, if damage should not occur. If these standard are not met, the cost of repairs and/or replacement will be charged to the tenant. Should the cost exceed the sum left, the tenant will be ask o pay extra.
12) Agency responsibility
Immobilservice acts as agent of the landlord and as mediator. As such, the Agency cannot be held responsible for: damages; injuries; loss/stolen property; or any other inconvenience. However, the Agency will provide its service to help to resolve any inconvenience. Any request of refund should be addressed directly to the proprietor/landlord, through the Agency.
13) Controversies
Any objection to this writing (document) will be resolved amicably, the controversies will be taken to the court of law of Venice (Camera arbitrale Immobiliare) as required by the law in force.
14) Privacy Statement
All the details provided by the client will be treated confidentially, according to the Data Protection Act Law 675/96. The information will be used only to put forward to the client offers, price lists for the new season and catalogues.
